Untangling a Zoning Delay from the Private Provider Clock

A residential permit was held by a building department pending zoning sign-off, with the department treating the zoning delay as though it fell under the same §553.791 deemed-approved clock as the building code plan review.

The approach. CCC clarified in writing that §553.791 governs Building Code Services review only. Zoning and fire proof-of-approval are required as completeness items under §553.791(1)(l)(4), but zoning review itself runs on a separate agency track, not the private provider deadline. The building code portion of the submittal had already cleared within its statutory window and was not properly held pending an unrelated zoning process.

The outcome. The building department separated the two tracks correctly going forward, releasing the building code approval on its own timeline while zoning proceeded independently.

The takeaway. This is one of the most common and most fixable misunderstandings in Florida private provider permitting: zoning and building code review are not the same clock, and conflating them costs projects real time.
